1. Agreement to Terms

By accessing or using Reply in DM ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

Reply in DM is a comment-to-DM automation and subscriber messaging tool. It allows you to connect your Instagram and/or Facebook accounts and:

  • Set up rules that automatically send direct messages to people who comment on your posts.
  • Build subscriber lists through confirmed opt-in (users tap a Subscribe button in a DM after commenting or DMing a trigger word).
  • Send broadcast messages to your subscriber lists, either immediately or on a schedule.

The service operates through Meta’s official APIs.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. By creating an account, you represent that the information you provide is accurate and that you have the authority to connect any social media accounts you link.

4. Your Account

  • You are responsible for keeping your account credentials secure.
  • You are responsible for all activity under your account.
  • Notify us immediately if you suspect unauthorized use of your account.

5. Acceptable Use

You agree not to:

  • Use the Service to send spam, unsolicited messages, or content that violates any applicable law or platform policy.
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Use the Service in any way that could damage, disable, or overburden our infrastructure.
  • Send messages containing hate speech, harassment, threats, or illegal content.
  • Violate Instagram’s or Facebook’s Terms of Service or Community Guidelines.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Subscribers, Broadcasts, and Consent

The Service lets you collect subscribers and send them broadcast messages. You agree to the following rules when using these features:

  • Confirmed opt-in only. Subscribers join your lists by actively tapping a Subscribe button in a DM we send on your behalf. You may not manually add people to a list without their confirmed consent.
  • Opt-out must stay available.Every broadcast includes a “Reply STOP” footer. You agree not to remove, circumvent, or disable the unsubscribe mechanism. When a subscriber opts out, we remove them from your list automatically.
  • Relevant content only. Broadcasts must relate to the topic that the subscriber originally opted in for. Sudden changes in content category (e.g. from a cooking list to crypto promotions) may trigger Meta deliverability penalties and are a violation of these Terms.
  • Frequency. Respect normal messaging frequency. Excessive broadcast volume may be throttled by Meta and can result in suspension of your account with us.
  • Data accuracy. You are responsible for keeping your subscriber lists accurate and for honoring individual deletion or access requests from your subscribers where required by law (e.g. GDPR).

Meta ultimately controls message delivery. We make no guarantee that every broadcast will reach every subscriber. Deliverability depends on factors including (but not limited to) Meta’s policies, the subscriber’s messaging history, and their privacy settings.

7. Content and Messages

You retain ownership of the content you create and the messages you configure. By using the Service, you grant us a limited license to store, transmit, and deliver your messages as necessary to operate the Service. You are solely responsible for the content of your auto-reply messages and broadcasts.

8. Third-Party Platforms

The Service relies on Meta’s APIs for Instagram and Facebook. We are not responsible for changes Meta makes to their APIs, policies, or terms that may affect the Service’s functionality. You must also comply with Meta’s Terms of Service when using Reply in DM.

9. Pricing and Payment

The Free plan includes all core features. DMs and broadcasts sent on the Free plan include a "Sent via replyindm.com" branding note. The Pro plan ($9/month) removes this branding. Pricing and billing terms are clearly presented before you are charged. We will not retroactively charge for features that were free when you started using them.

10. Service Availability

We aim to keep the Service running smoothly, but we do not guarantee 100% uptime. We may occasionally need to perform maintenance, and third-party APIs may experience their own outages. We are not liable for any losses resulting from temporary unavailability.

11. Limitation of Liability

To the maximum extent permitted by law, Reply in DM and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim (if any).

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that all DMs will be delivered successfully.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden.
